Terms of Service

Flexity is an information and analytics terminal for public prediction-market data, with an AI analysis layer. It is not financial advice and is not affiliated with Polymarket. Please read these Terms carefully.

1. Agreement

By accessing or using Flexity, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old and legally able to enter into this agreement. You may not use Flexity if you are located in, or a resident of, a country or region subject to comprehensive sanctions, or if you are on any applicable sanctions / denied-party list. You are responsible for complying with the laws that apply to you, including whether accessing prediction-market data or trading on prediction markets is lawful where you are.

Geographic restrictions. Browsing market data, AI analysis, and managing your subscription are available wherever lawful. However, the funding and order-placement features are geo-restricted: they are disabled in the United States and in every region where Polymarket itself blocks access. We determine this in good faith using Polymarket’s own geo-availability check against your connection. If your region is restricted, you can still use the information tools but cannot fund a Polymarket account or place orders through Flexity. Attempting to circumvent these restrictions (for example by VPN) is a violation of these Terms, and any such order may in any case be rejected by Polymarket.

3. What Flexity is — and is not

• Flexity is an information and analytics terminal. It aggregates and visualises public prediction-market data (primarily Polymarket) and produces AI-generated analysis on top of it.
• Flexity is not a broker, dealer, exchange, prediction market, custodian, or money-services business. We never take custody of your funds, assets, or private keys.
• Where we provide order-placement or funding tools, they are strictly non-custodial: you authorise every action by signing in your own wallet, your funds remain in your own Polymarket account (a smart-contract wallet you control), and any order is submitted to and matched by Polymarket — not by us. We are a software interface, not a counterparty, intermediary, or holder of your money.
• Flexity is not affiliated with, endorsed by, or operated by Polymarket or any market it displays. All trademarks belong to their owners.
• Nothing in Flexity is financial, investment, legal, tax, or trading advice, a recommendation, or a solicitation to buy or sell anything (see §10).

4. Accounts and sign-in

• You can sign in two ways: (a) connecting an existing crypto wallet and signing a message, or (b) with email or Google, which creates a self-custodial embedded wallet for you via our provider. Either way you alone control the wallet; we never receive your seed phrase or private keys.
• You are responsible for the security of your wallet, login, device, and any activity under your account. Anyone who controls your wallet or login can control your account.
• You agree not to impersonate others or use a wallet or account you are not authorised to use.

5. Plans, pricing, and billing

5.1 Plans

Flexity offers three tiers, each at a single monthly price. Free includes a daily AI-analysis allowance; paid tiers raise the daily limit (Ultimate is unlimited). Listed paid prices are an introductory launch discount off the regular price.

Prices are in US dollars and charged in cryptocurrency at checkout. We may change features or prices prospectively; we will give reasonable notice of price changes, which take effect on your next renewal.

5.2 Payment in cryptocurrency

Paid plans are billed through our payment provider NOWPayments in cryptocurrency (e.g. USDC and other supported coins). By subscribing you also agree to the payment provider’s terms. You are responsible for network/gas fees and for sending the correct asset on the correct network. Sending the wrong asset or using the wrong network may result in permanent loss of funds, for which we are not responsible.

5.3 Renewal & cancellation

Paid plans are monthly. You may cancel at any time; cancellation stops future renewals, and your paid access continues until the end of the current period, after which your account reverts to Free.

5.4 Refunds

Except where required by mandatory law, cryptocurrency payments are final and non-refundable, including for partial billing periods and unused time.

5.5 Taxes

Stated prices may exclude taxes. You are responsible for any taxes that apply to you other than taxes on our net income.

6. Acceptable use

You agree not to: scrape or bulk-extract data except via features we expressly provide; resell or redistribute Flexity’s data, analyses, or outputs without our written permission; circumvent plan limits, paywalls, authentication, or security; interfere with or disrupt the service; use Flexity for unlawful purposes; or reverse-engineer the service except as permitted by law. We may suspend or terminate access for violations.

7. Intellectual property

The Flexity software, design, branding, and AI-generated analyses are owned by us or our licensors. We grant you a limited, revocable, non-exclusive, non-transferable licence to use them for your personal, internal purposes consistent with your plan. Underlying market data is owned by its respective sources (e.g. Polymarket). All rights not expressly granted are reserved.

8. Third-party services

Flexity relies on and links to third parties (Polymarket and its deposit bridge, public blockchains, our embedded-wallet provider for email/Google sign-in, our subscription payment provider, and AI providers). We are not responsible for third-party services, their availability, accuracy, or actions, and your funds and orders are handled by Polymarket and the blockchain — not by us. Your use of these services is governed by their terms.

9. AI outputs

AI Scores, analyses, summaries, and agent outputs are generated by automated models, are probabilistic and may be incomplete, outdated, or wrong, and are provided “as is.” Do not rely on them as the sole basis for any decision. They are not advice.

10. No financial advice; assumption of risk

Flexity provides information and tools only. Prediction markets and crypto assets are high-risk and you can lose money. You are solely responsible for your own decisions and trades, which you make at your own risk on third-party platforms. We do not guarantee the accuracy, completeness, or timeliness of any data or analysis. You should obtain independent professional advice before making financial decisions.

11. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

12. Limitation of liability

To the maximum extent permitted by law, we and our suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or trading losses, arising from or related to your use of (or inability to use) Flexity. Our total aggregate liability for all claims will not exceed the greater of (a) the amounts you paid us in the 3 months before the event giving rise to the claim, or (b) USD $100.

13. Indemnification

You agree to indemnify and hold harmless Flexity and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the service or violation of these Terms or applicable law.

14. Suspension & termination

We may suspend or terminate your access at any time for violation of these Terms, suspected fraud or abuse, or where required by law. Sections that by their nature should survive termination (e.g. IP, disclaimers, limitation of liability) survive.

15. Changes to these Terms

We may update these Terms. Material changes will be posted with a new effective date and, where appropriate, additional notice. Continued use after changes means you accept the updated Terms.
